    After the case of Joseph Shine, the supreme court had laid down that adultery is no longer an offense which can be penalized and a husband is not the master of his wife. Now a wife can have sexual intercourse with another man without the consent of her husband. Earlier, such a man who had sexual intercourse with a lady (despite knowing she is married) was guilty of committing adultery and the punishment for the same was imprisonment which could extend up to 5 years or fine and if it seems appropriate to the court both could be imposed now there is no such provision for penalizing. Some people of the society call it women empowerment whereas others say the sanctity of marriage is being destroyed.



    Dear Sir/Madam,
    Now, adultery made no punishable offence as such they aggrieved husband may resort to the following Section of Indian Penal Code.
    Section 498 in The Indian Penal Code
    498. Enticing or taking away or detaining with criminal intent a married woman.—Whoever takes or entices away any woman who is and whom he knows or has reason to believe to be the wife of any other man, from that man, or from any person having the care of her on behalf of that man, with intent that she may have illicit intercourse with any person, or conceals or detains with that intent any such woman, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
